FULL TERMS OF SERVICE

Scope & DefinitionsThese Terms of Service ("Terms") govern every commission, YCH slot, and piece of physical merchandise sold by Pudgical — whether ordered through this website, Telegram, Bluesky, X/Twitter, FurAffinity, or purchased in person at a convention table. Sending a deposit, completing payment, or buying an item at a table means you accept these terms in full.Commission - Custom digital or traditional artwork made to your specification (illustration, badge, sketch, comic panel, YCH slot).
Merchandise - Pre-made physical items (prints, badges, charms, stickers) sold as-is, typically at conventions.
YCH ("Your Character Here") - A pre-drawn or partially drawn piece auctioned or sold flat-rate, customized to the winning bidder's character.2. Eligibility & Age Requirements- You must be 18 or older to commission me, whether SFW or NSFW, no exceptions. I will not work with minors.
- By requesting NSFW content, you confirm you are a legal adult in your own jurisdiction and that every character depicted is an adult (18+), regardless of species, size, or in-universe age.
- I will not draw, discuss, or accept commissions sexualizing minors or child-coded characters, regardless of species or "aged-up" framing. This is non-negotiable and results in immediate refusal, a full refund of any payment received, and a permanent ban on commissioning me.3. Commission Types & How to Order- Open/closed status and current pricing are posted here and on socialsTo Commission: Message me on Telegram, Bluesky, or X/Twitter with reference images, and a description of what you'd like. I'll confirm availability, price, and an estimated start date and timeline before requesting payment.Your slot is only reserved once payment (or the agreed deposit) is received — messaging interest alone does not hold a place in the queue.YCH Auctions: The winning bid or claimed slot must be paid within 24 hours of the auction closing or the slot being confirmed.I reserve the right to decline any commission, for any reason, before work begins, with a full refund of anything already paid.4. Content Policy — What I Will and Won't DrawI will draw:
- Any species, feral or anthro, solo or group pieces, most themes and most fetish content on a case-by-case basis, ask if you're unsure whether something fits.I will not draw:
- Content sexualizing minors, "loli/shota," or child-coded characters, in any context
- Non-consensual sexual content, bestiality (real-animal-on-anthro), or anything involving real people without their explicit consent
- Hate symbols or content promoting discrimination, harassment, or real-world violence
- Direct copies of another artist's style, or someone else's OC/copyrighted character without permission or a licenseIf a request falls in a gray area, I'll ask clarifying questions before starting rather than guessing.5. Pricing & Payment- All prices are listed in EUR (€) unless stated otherwise; currency conversion for other currencies is the client's responsibility.
- Invoice is sent via PayPal or Bank Transfer
- Commissions require full payment upfront before work can start.
- Adding an extra character to an existing piece costs 60% of that character's base price.
- Payment plans can be arranged in advance for larger pieces (comics, multi-character illustrations) — ask before committing to the order.
- In the rare case of partial payment being accepted, 50% deposit is required to enter the queue and provide sketches for approval, the remaining 50% is due before final files are released.
- Chargebacks or payment disputes filed without contacting me first will result in a permanent block from future commissions and may be contested using our message and payment history as evidence.6. Revisions- A sketch/WIP stage is shown before rendering begins — this is your chance to request changes to pose, colors, or composition at no charge.
- Minor revisions after the sketch stage is included free. Major changes requested after linework or coloring has started (new pose, different character, added elements) are an additional fee or in some cases, may be refused.
- Once a piece is marked complete and delivered, the commission is final. Fixes for an artist-side error (wrong species, wrong colors, missed a marking or listed detail) are always free.7. Turnaround Time & Queue- Typical turnaround is 90 days, though this varies with queue size, convention prep, and piece complexity — you'll get an estimate at order time.
- Updates are posted on Telegram (t.me/pudgicalArt) and socials — check there before messaging to ask for a progress update.
- Convention prep periods and short personal breaks may pause the queue; anything already paid for keeps its place in line.8. Cancellations & RefundsBefore Work Starts: Full refund if you cancel, or if I decline the commission.Sketch Stage: 70% Refund, pose may be reused as a YCH or for another commission.Rendering Stage: 30% Refund.Completed: No refunds for a change of mind. Refunds for a genuine mistake on my part are handled on a case-by-case, up to and including a full refund or a redo.Unforeseen Delays: If I go unreachable for an extended period of time, or have made no progress on your commission for more than 90 days, you're entitled to a full refund regardless of progress or stage.9. Usage Rights & Copyright- I retain full copyright over every commission, including your character(s) as drawn by me. You do not receive rights to resell the artwork, mint it as an NFT, or use it commercially unless we agree to that separately in writing (priced accordingly).
- You may post the finished piece for personal use — social media, icons, wallpapers, prints for yourself — with credit to me and a link back where possible.
- I retain the right to post commissioned work in my portfolio, on socials, and in advertising (queue examples, YCH previews) unless you've purchased an explicit privacy add-on beforehand.
- Please don't crop out or remove any signature / logo / watermark.10. Convention & Dealer's Den SalesThis section covers anything bought in person at a convention table ( EF, NFC, and other conventions I may attend as a vendor ).- Prints, badges, charms, and other pre-made merchandise are sold as-is. All sales are final — no refunds or exchanges, except for a genuine manufacturing defect.
- Con badges or traditional sketches taken at-table follow the same queue and payment rules as digital commissions (Sections 3, 5–8), with the deposit or full payment collected on the spot. Pieces not finished during the con are mailed afterward (if required) with shipping added, unless you arrange pickup at a future convention.
- Accepted payment at-table: cash, card or PayPal. I'm not responsible for items lost, stolen, or damaged after they leave my table.
- Preorders for convention pickup are arranged ahead of time to reserve and pay. Bring proof of payment to collect, I am not always at the table. Unclaimed preorders are held until close of the dealer's den and mailed afterward at your cost if missed.
- I follow the vendor rules and code of conduct of whichever convention I'm tabling at; those rules apply on top of, not instead of, these Terms.
- Applicable sales tax or VAT is charged according to that convention's venue and jurisdiction at the time of sale.11. Shipping & Traditional Commissions- Traditional (physical, hand-drawn) commissions and mailed merchandise are shipped once complete; the buyer covers shipping cost, quoted at order time based on destination and package size.
- Merchandise and finished traditional pieces are dispatched within 3-10 business days of payment clearing, separate from commission turnaround (Section 7).
- International orders may be subject to customs fees, import duties, or delivery delays outside my control — these are the buyer's responsibility, not mine. I am EU Ireland based.
- You're responsible for providing a correct, deliverable shipping address. Packages returned or lost due to an incorrect address are re-shipped at your cost.
- I package physical work carefully, but I'm not responsible for carrier damage in transit; tracked shipping is used where possible so we can file a claim together if that happens.
- Once tracking confirms delivery, the item is your responsibility — I'm not liable for loss, theft, or damage after that point.
- Physical originals and merchandise aren't returnable once received in the condition ordered; a lost- or damaged-in-transit claim goes through the carrier, not as a refund from me.12. AI Use, Liability, Changes & Contact- I do not use AI/machine-learning image generation in any commissioned work. In turn, please don't upload commissioned art to AI training datasets, "art generator" prompts, or NFT projects — this breaches the usage terms in Section 9.
- Artwork is provided as-is; I'm not liable for how you use, host, or share the final files after delivery.
- These Terms may be updated at any time. The version in effect on the date you paid your deposit is the one that applies to your commission.
